Terminating the Service


By You. You may terminate any of the Services or subscriptions at any time by texting STOP to any inbound message or Replying stop to any message you have received in the last 30 days. By AutomaticPolicy. You agree that AutomaticPolicy, at its sole discretion, may at any time terminate your use of all or any portion of the Services and/or change its content offering made available through the Services, if AutomaticPolicy believes that you have violated or acted inconsistently with this Agreement. You agree that AutomaticPolicy shall not be liable to you or any third party for any termination of your access to the Services.


Description of the Services


AutomaticPolicy provides text message-based services such as product announcements, specials and promotions. You acknowledge and agree that the Services are for your personal use only. You may not use the Services to sell a product or service, or to increase traffic to your business for commercial reasons, such as advertising sales. If you want to make commercial use of the Services, you must enter into an agreement with AutomaticPolicy to do so in advance. Please contact us for more information. AutomaticPolicy occasionally provides links or access to websites, services or properties owned by third parties (collectively “Third Party Links”). AutomaticPolicy

 does not own or operate such Third Party Links and is not responsible for the content or performance of any Third Party Links. AutomaticPolicy does not share, rent or sell any Personally Identifiable Information with any third party.

Access to the Services


In order to use the Services, you must have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network for which AutomaticPolicy makes the Services available as well as any carrier services necessary to send text messages, and pay any service fees associated with any such access. YOUR CARRIER’S TEXT MESSAGING RATES WILL APPLY TO ALL TEXT MESSAGE COMMUNICATIONS MADE IN CONNECTION WITH THE SERVICES. ACCORDINGLY, ALL PRICING, BILLING, REFUND AND OTHER RELATED INQUIRIES AND SUPPORT MUST BE DIRECTED TO YOUR CARRIER’S CUSTOMER SUPPORT TEAM. Supported Carriers include: AT&T, Verizon Wireless, T-mobile, MetroPCS, Sprint, Boost Mobile, Virgin Mobile, US Cellular. The Wireless Carriers are not liable for delayed or undelivered messages. In addition, you must provide all equipment and software necessary to connect to the Services, including, but not limited to, a mobile hand set or other mobile access device that is in working order and suitable for use in connection with the Service. If any upgrade in or to the Services requires changes in your equipment or software, you must effect these changes at your own expense. Unless explicitly stated otherwise, any new or additional features that augment or enhance the current Services shall be subject to the terms and conditions of this Agreement. AutomaticPolicy reserves the right at any time and from time to time to modify, suspend, limit the use of, discontinue or permanently cancel all or any portion of the Services. AutomaticPolicy uses reasonable efforts to ensure that the Services are always available. However, there will be occasions when the Services will be interrupted for maintenance, upgrades and emergency repairs or due to failure of telecommunications links and equipment that are beyond our control. By using the Services, you agree that AutomaticPolicy will not be liable to you for any modification, suspension or discontinuance of the Services.


Purchases


If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.


You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.


The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.


We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

Contests, Sweepstakes and Promotions

Subscriptions


Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.


At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or AutomaticPolicy cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting AutomaticPolicy customer support team.


A valid payment method, including credit card or PayPal, is required to process the payment for your Subscription. You shall provide AutomaticPolicy with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize AutomaticPolicy to charge all Subscription fees incurred through your account to any such payment instruments.


Should automatic billing fail to occur for any reason, AutomaticPolicy will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.


Free Trial


AutomaticPolicy may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (“Free Trial”).


You may be required to enter your billing information in order to sign up for the Free Trial.


If you do enter your billing information when signing up for the Free Trial, you will not be charged by AutomaticPolicy until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.


At any time and without notice, AutomaticPolicy reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.


Fee Changes


AutomaticPolicy, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.


AutomaticPolicy will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.


Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.


Refunds


Except when required by law, paid Subscription fees are non-refundable.


Accounts


When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.


You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.


We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Termination


We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.


If you wish to terminate your account, you may simply discontinue using the Service.


All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.


Governing Law


These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.


Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
